Nullifying a Jury

The California Supreme Court ruled in 2001 that if a juror sees that a fellow juror is trying to question the law, the judge must be notified. This does not cause jury nullification to not theoretically happen in California (or elsewhere) because of double jeopardy -- an acquitted defendant can not be retried.
For jury nullication to happen, the juror must be covert.
