Summary of federal level gun control laws

The National Firearms Act of 1934

  • Mandated registration and banned new manufacture of:
    • Destructive devices (bore size larger than .5 inches)
  • Mandated registration and transfer tax of $200 on:
    • Short-barrelled rifles (shorter than 16")
    • Silencers
    • Full-auto/burstfire weapons
    • Anything not a pistol and shorter overall (buttplate to muzzle) than 26"
  • Mandated registration and transfer tax of $5 on
    • Short-barreled shotguns (shorter than 18")

Gun Control Act of 1968

This Act did a lot of things, some sensible, some absolutely stupid, but here are the big things:

  • Prohibited importation of weapons banned by the 1934 NFA.
  • Prohibited certain people from owning guns. (convicted felons, insane, etc)
  • Mandated serial numbering
  • Created the Federal Firearms Licensing (FFL) system

Firearm Owner's Protection Act of 1986

This Act generally protected gun owners from ATF harassment. It:

  • Restricted the ATF (bureau of Alcohol, Tobacco, Firearms, and Explosives)'s FFL authority
  • Prohibited manufacture of new machine guns (full auto/3 round burst) for sale to public
  • Clarified CGA "prohibited persons" list (which passed house and senate in two different forms)
  • Stated that guns could be taken through states where such a gun might violate laws, given certain provisions (properly stored, no unreasonable stops, must be legal in destination and origin state)

Note: Bill was favored by the NRA, the machine gun ban was introduced at the last minute, NRA thought it would be ruled unconstitutional, so lobbied to get it passed anyways, SCOTUS ruled it constitutional, and now an otherwise $1,000 AR-15 is a $16,000 AR-15, and still rising in price.

Firearm Owner's Protection Act of 1986

This act, which expired in 2004, did the following:

  • Banned "evil" guns by name.
    • AK-47/74
    • AR-15
    • Tec-9
    • MAC-10
    • Uzi
    • other scary guns
  • Banned semi-auto center-fire rifles with more than two of the following:
    • Pistol grips
    • Flash suppressors
    • Bayonet lugs
    • Collapsing stocks
    • Grenade/flare launchers
    • Threaded barrel tip (could be used to add silencer)
  • Banned pistols with more than two of the following:
    • Magazine that attaches outside the pistol grip
    • Threaded barrel tip (could be used to add silencer)
    • Barrel shroud
    • Weighs 50 oz or more
    • Semi-auto version of automatic gun
  • Banned semi-auto shotguns with more than two:
    • Pistol grip
    • Removable magazine
    • Holds 5 rounds
    • Collapsing stock
  • Banned making new magazines that held more than 10 rounds, could be easily converted.

The effect it had on crime was admitted by congress to be statistically indistinguishable from zero, which contributed to it not being renewed after it's 10 year sunset provision invalidated the law.
